How Eligibility is Determined

Under Age 5

There are three ways that a child under the age of five can be determined eligible for Rule 185.

  1. The child has test scores of more than 2 standard deviations below the mean in 2 global areas of functioning; one of which is cognition, and the child is at risk of developmental disabilities.
  2. The child may have been assessed and diagnosed by a psychologist as having Global Developmental Delays.
  3. The child may have a related condition that results in impairment of general intellectual functioning or adaptive behavior similar to that of a person with developmental disabilities. Related conditions include, but are not limited to Cerebral Palsy, Autism, Epilepsy, Prader-Willi Syndrome, Fetal Alcohol Syndrome and Autism.

Age 5 & Older

A person must have a psychological evaluation completed with the last year, and an adaptive skills assessment that documents current delays of 2 standard scores below the mean and full scale IQ of 70 or lower. If those criteria are not met, we determine if the person meets criteria for a Related Condition.
